L’Institut d’Estudis Catalans, acadèmia nacional de les ciències i les humanitats, entén que és políticament insòlit i inadmissible que el Tribunal Constitucional s’atorgui el dret de decidir sobre la constitucionalitat de l’Estatut d’autonomia de Catalunya menyspreant la decisió del poble de Catalunya, el qual, en plebiscitar l’Estatut, li va conferir un caràcter constituent per al territori de Catalunya.
Altrament, l’Institut d’Estudis Catalans considera que la Sentència del Tribunal Constitucional sobre l’Estatut, pel que fa al concepte de nació, el tractament i l’abast de l’oficialitat de la llengua catalana, del dret civil de Catalunya i dels drets històrics i lingüístics del poble de Catalunya, entre altres qüestions, vulnera greument la voluntat popular expressada en referèndum. Aquesta resolució posa de manifest un retrocés democràtic que es pot traduir en conseqüències inacceptables per al desenvolupament de la vida política, econòmica, social i cultural de Catalunya.
Catalunya, com a poble mil•lenari, s’ha reconegut com una nació i, per tant, és subjecte de drets col•lectius establerts internacionalment (Carta de les Nacions Unides i pactes internacionals dels drets civils, polítics, econòmics, socials i culturals de les Nacions Unides) i té el dret inalienable, previ a la Constitució espanyola, de configurar l’àmbit jurídic de la seva llengua i la seva cultura, la seva economia o la seva societat.
Sens perjudici d’analitzar més a fons el contingut íntegre de la Sentència del Tribunal Constitucional pel que fa a altres àmbits, com ara el dret, l’economia, determinades competències i símbols nacionals, l’Institut d’Estudis Catalans, acadèmia de la llengua catalana, rebutja qualsevol acte que limiti l’eficàcia dels drets lingüístics individuals i col•lectius i rebaixi l’ús preferent que el català, com a llengua oficial i pròpia, ha de tenir davant de totes les administracions públiques i els mitjans de comunicació públics.
L’Institut d’Estudis Catalans expressa el seu rebuig més enèrgic davant la resolució del Tribunal Constitucional, que desnaturalitza l’Estatut d’autonomia de Catalunya, i crida la ciutadania a defensar cívicament i amb tota la fermesa el dret del poble català a decidir democràticament el seu futur.

Statement of the Institute of Catalan Studies regarding the ruling of the Constitutional Court on the Statute of Autonomy
The Institute of Catalan Studies, national academy of sciences and humanities, regards it as politically unheard-of and unacceptable that the Constitutional Court grant itself the right to decide on the constitutionality of the Statute of Autonomy, scorning the decision of the people of Catalonia, which, by voting it in a referendum, confers upon it a constituent status for the territory of Catalonia.
Moreover, the Institute of Catalan Studies considers that the Constitutional Court Ruling on the Statute, as regards the concept of nation, the treatment and scope of the official recognition of the Catalan language, of Catalan civil law and of the historical and linguistic rights of the people of Catalonia, among other things, seriously undermines the popular will expressed by referendum. This resolution highlights a democratic setback that can lead to unacceptable consequences for the development of the political, economic, social and cultural life of Catalonia.
Catalonia, as a thousand-year-old people, has recognized itself as a nation and therefore is the subject of collective rights established internationally (United Nations Charter and United Nations international covenants of civil, political, economic, social and cultural rights) and has the inalienable right, prior to the Spanish Constitution, of setting up the legal framework for its language and its culture, its economy and its society.
Subject to further analysis of the content of the Constitutional Court Ruling in regard to other areas such as law, economics, certain powers and national symbols, the Institute of Catalan Studies, the Catalan Language Academy, rejects any action that limits the effectiveness of individual and group linguistic rights and reduces the preferential use that Catalan, as an official language and as Catalonia’s own language, should have before all public authorities and the public media.
The Institute of Catalan Studies expresses its most energetic rejection of the Constitutional Court resolution, which disfigures the Statute of Autonomy, and it calls on citizens to defend civically and with all the firmness the right of the Catalan people to democratically decide their future.
